These terms pertain to the contract of the sale and purchase of goods
between you and The Pot and Grass Company.

placing an order with The Pot and Grass Company you agree to accept the
following terms and conditions.

The
terms and conditions of the contract do not affect your statutory rights.

A
contract is created for The Pot and Grass Company to sell you goods when we
accept an order from you made in writing, by telephone or on-line via our
web site.

Orders
are considered accepted when we confirm the products are available
and your credit or debit card or your customer account is
authorised for the
transaction.

The
contract for The Pot and Grass Company to supply the goods as described becomes
binding once the payment including VAT and shipping has been received by The
Pot and Grass Company in full.

Payment methods accepted for online sales are
customer account. Credit
and debit cards, personal cheque, electronic transfer, money order, and
Paypal.

The
Pot and Grass Company will charge your credit or debit card account for payment
on receipt of your order. We accept no liability if a delivery is delayed due
to incorrect payment details.

Goods
remain the property of The Pot and Grass until full payment has been
received.

All
Prices (unless stated) are shown inclusive of VAT but not delivery.

Returned or represented cheque's will be charged a £12
administration fee.

Prices are subject to alteration. However orders that have
been accepted will only be charged at the prices quoted at the time the
order is accepted.

Orders that are cancelled after a transaction has been processed will incure the transaction charges for the principle transaction and the refund. The transaction fees will be deducted from the refund amount.

Refunds will usualy be made by bankers cheque made payable to customer and mailed to the address on the original invoice.

Claims arising from shortages or damages must be made
within 3 working days from receipt of the goods. All damaged/shortages of
parcels must be signed for or reported as damaged/parcel shortage to the
carrier.

Goods dispatched to a third party are at the
purchaser's risk.

Goods left unsecured at the purchaser's instructions
remain the purchaser’s risk.

All goods are subject to delivery costs unless collected
from The Pot and Grass Company premises in person.

All descriptions, sizes, shape, and colour of plants and
products on the Pot and Grass web site are for guidance only. The individual
product delivered will be true to type however may vary slightly from the
description.

Substitute plants will not be made or dispatched without
the purchasers consent. If by chance a product has been ordered that is
unavailable or does not meet the required company standards for shipment, the
Pot and Grass Company reserve the right to offer a substitute plant or plants
that is considered the closest match. The purchaser will be informed prior
to any substitution. If a substitute is not acceptable to the customer the Pot
and Grass Company will deduct from the order total or refund the cost of that
particular item.

Tagging deposits paid for plants that have been reserved
using the plant tagging option will be retained as a cancellation charge if the
order is cancelled.
Plants are usually dispatched within 7 to 14 days subject to condition and availability or in some cases such as Imperator as they become ready.
Under the Consumer
Protection - 'Distance Selling Regulations 2000' you (the consumer) have the
right to cancel your order within a 7 working day period. The cancellation
period starts from the day that the goods are received.
The regulations
require that the consumer (you) to send notice of cancellation in
writing, fax, or email.* In the event of cancellation, the goods must be
returned in the same condition as delivered and at the consumer's own expense.
If the goods are not returned within 7 days the Pot and Grass Company may
arrange for the goods to be collected and the incurred cost will be
debited from the refund amount. *(A telephone cancellation is not
considered adequate a refund can not be made unless a written email or fax cancellation has been received).
Unless an insurance or compensation option is offered at the checkout and clearly stated on your order confirmation/invoice, plants are
dispatched without insurance cover. If insurance is required it remains the
customer's responsibility to check the appropriate box in the check out procedure if an option is offered or arrange alternative private insurance.
You’re Responsibility.
The plants will be delivered properly packaged by first class mail parcel
carrier or courier, directly from us at the P&G. The plants should reach
you in first class condition. On receiving the plants open the packaging immediately checks the order and place the plant in a light sheltered
area. Make sure the root does not dry out. Retain the packaging material. Check
and follow the planting instructions enclosed. If you are uncertain about the
planting instructions refer to the relevant web site pages. If you are still
unsure use the customer support link to get help. You must take care in the
planting and you must take proper after care of your plant.
If the plant is badly damaged during transit we will replace it or refund you.
However you must inform The Pot and Grass Company immediately and make the
required report to the carrier or when signing on delivery or Royal Mail. The goods must be
returned/dispatched, in or with the original packaging, with proof of
posting within 3 working days from date of delivery.

No refunds or replacement can be made without the return of the plant/plants and packaging
with proof of posting Royal Mail report number.
Our customer's are
very important to us and we take any complaint you may have regarding products
and service very seriously. If you feel you have a complaint please contact us
using customer support giving us as much detail as you can about the
complaint or the product including your telephone number and invoice/order
number. This will enable us to have your details at hand when we contact you.
We cannot be held
responsible for failure due to adverse weather conditions or incorrect planting
and aftercare subsequent to the accepted delivery of the plants.
